Religious claims often come in two forms: disparate treatment because of religion, and failure to accommodate religious practice. Retaliation after a request or complaint is a third track.

  • Schedule and Sabbath conflicts: Shift changes or mandatory events that collide with worship — without meaningful interactive discussion.
  • Dress and grooming: Policies applied rigidly to religious attire or grooming without exploring alternatives.
  • Hostile environment: Mockery or pressure to abandon religious practice severe or pervasive enough to alter work conditions.

Undue hardship is not rubber-stamped

Employers must show real hardship under current Title VII standards — not mere coworker grumbling. We test whether alternatives were considered in good faith.

Virginia and federal practice

Do I have to belong to an organized religion?

Title VII protects sincerely held religious beliefs, which can include beliefs outside major organized faiths when they meet the legal standard.

Can my employer deny every schedule accommodation?

Not automatically. They must assess undue hardship and consider alternatives. Blanket refusals are vulnerable.

What if coworkers object to my accommodation?

Coworker preference alone is usually not undue hardship. The analysis is more demanding than popularity contests.

Can religious discrimination cases be contingent fee?
