USERRA Lawyers

USERRA protects service members and reservists in reemployment, promotion, benefits, and freedom from discrimination or retaliation because of uniformed service. These are federal claims we evaluate nationwide — especially relevant in Virginia’s military and contractor communities.

J. Madison PLC is licensed in Virginia. We handle Virginia employment matters and federal employment claims (including EEOC, MSPB, FCA, and Defense Contractor Whistleblower Protection Act matters) nationwide where permitted. Pure other-state law claims may require local counsel, which you may be able to find through our affiliate network.

Core USERRA protections

USERRA is broader than “get your job back.” It reaches hiring, reemployment escalation, benefits continuity, and hostility toward military obligations.

  • Reemployment: Prompt reinstatement to the correct status after qualifying service when statutory conditions are met.
  • Discrimination: Adverse action because of membership, application for service, or service obligations.
  • Retaliation: Punishment for asserting USERRA rights or assisting in a USERRA matter.

Civilian careers and clearance pressure

Reservists in contractor and federal-adjacent roles often face schedule hostility or “reliability” narratives. We evaluate USERRA alongside related retaliation theories when the facts overlap — without confusing USERRA with Title VII.

Evidence and forums

Keep orders, notice to the employer, and every reemployment email. DOL VETS complaints and court actions are fact-specific paths. Cloud Counsel is the secondary file-building tool while we underwrite.

Frequently Asked Questions

Does USERRA apply to private employers?

Yes. USERRA covers most private and public employers with few size thresholds compared to Title VII.

What if my job changed while I was deployed?

Reemployment aims at the position you would have attained with reasonable certainty — not always the exact pre-service desk. We analyze escalation and qualifications issues carefully.

Is USERRA the same as military leave under FMLA?

No. They are different statutes with different coverage rules. Some situations implicate both; we map which fits.

Can USERRA cases be contingent fee?

Often when facts and damages support underwriting. Acceptance is not guaranteed.
